1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of the Maré website, store, and all related information, content, features, tools, products, and services (collectively, the "Services"). By visiting, browsing, or making a purchase on our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Maré ("we," "us," "our," or "Company") operates this store and website. If you do not agree to these Terms, you may not access or use the Services.

Maré is powered by Shopify, which provides the underlying platform for our store and Services.

2. MODIFICATIONS TO TERMS

We may update these Terms from time to time at our sole discretion. We will post the revised Terms on this website and update the "Last Updated" date above. Your continued use of the Services following any such changes constitutes your acceptance of the updated Terms. We recommend that you review these Terms regularly for any changes.

3. USE OF SERVICES

3.1 Eligibility

By using the Services, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
  • You have the legal capacity to enter into a binding contract
  • You are not prohibited by law from purchasing products or using the Services
  • All information you provide is true, accurate, complete, and current

3.2 Prohibited Conduct

You agree that you will not, and will not permit others to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • Harass, threaten, embarrass, or cause distress or discomfort to any person or entity
  • Post, upload, or transmit any content that is abusive, hateful, defamatory, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to the Services, our systems, or networks
  • Use any automated tools, robots, scraping software, or other means to access, monitor, or copy any portion of the Services without our prior written consent
  • Interfere with the proper functioning of the Services or impede the rights of others

We reserve the right to terminate your access to the Services if you violate these Terms or engage in any prohibited conduct.

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership

All content on the Services, including but not limited to text, graphics, images, photographs, videos, designs, logos, trademarks, trade names, taglines, product names, and compilations, is the exclusive property of Maré or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License

We grant you a non-exclusive, non-transferable, revocable license to access and view the content on the Services solely for your personal, non-commercial use. This license does not permit you to:

  • Reproduce, distribute, transmit, or publicly display any content
  • Modify, translate, or create derivative works based on any content
  • Remove or alter any proprietary notices or labels
  • Use any content for commercial purposes without our prior written consent

4.3 User-Generated Content

If you submit, post, or display content on the Services (such as product reviews), you grant Maré a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, distribute, and display such content in connection with the Services.

5. PRODUCT INFORMATION & DISCLAIMERS

5.1 Artisanal Nature of Products

All Maré products are handmade by experienced artisans, one piece at a time, making each piece unique. Due to this handcrafted process:

  • Slight variations in colour tone, shape, size, or finish may occur between products
  • These variations are natural characteristics of artisanal goods and are not regarded as defects
  • Such variations will not be eligible for return or replacement
  • Each product's uniqueness is a feature, not a flaw

5.2 Product Descriptions

We strive to provide accurate and detailed descriptions of our products, including ingredients, scent profiles, and usage instructions. However:

  • Product descriptions are provided for informational purposes only
  • We do not guarantee that descriptions, images, or other content are error-free or completely accurate
  • Actual product appearance, colour, or scent may vary slightly from photographs due to lighting, display settings, or screen calibration
  • Some products may be customized or made-to-order; variations are intentional and not grounds for return

5.3 Fragrance & Ingredient Information

  • All Maré fragrances are artisanal EDPs (Eau de Parfum) made with carefully selected ingredients
  • We encourage you to review ingredient lists prior to purchase if you have sensitivities or allergies
  • Patch testing is recommended before full application, particularly for sensitive skin
  • We are not liable for adverse reactions; use at your own discretion
  • Do not ingest fragrances or apply to damaged or broken skin

5.4 Availability

Products are offered on an as-available basis. While we strive to maintain accurate inventory, we do not guarantee that items will remain in stock. If a product is unavailable, we will notify you before processing payment.

6. ACCOUNT & REGISTRATION

6.1 Account Creation

To make a purchase, you may be required to create an account or provide certain information. You agree to:

  • Provide accurate, complete, and current information
  • Keep your account credentials (username and password) confidential
  • Not share your login credentials with anyone else
  • Notify us immediately of any unauthorized access or use of your account

6.2 Account Responsibility

You are responsible for all activities that occur under your account, whether or not authorized by you. We are not liable for any unauthorized use of your account.

6.3 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms or engaged in prohibited conduct.

7. PAYMENT TERMS

7.1 Payment Methods

We accept various payment methods, including credit cards, debit cards, digital wallets, and Cash on Delivery (COD) where available. Payment information is processed securely through Shopify and our authorized payment processors.

7.2 Payment Authorization

By submitting payment information, you authorize us to charge your selected payment method for the full purchase amount, including any applicable taxes, shipping fees, or additional charges that may apply.

7.3 Pricing

  • All prices are listed in Indian Rupees (INR) and are subject to change without notice
  • We reserve the right to correct pricing errors on our website
  • If a pricing error is discovered, we will notify you before processing your order

7.4 Taxes & Duties

You are responsible for any applicable taxes, import duties, or other charges imposed by your jurisdiction. We will collect GST (Goods and Services Tax) where applicable under Indian law.

7.5 No Refund of Payment Processing Fees

Payment processing fees, currency conversion charges, or other fees incurred by payment processors are non-refundable.

8. SHIPPING & DELIVERY

8.1 Shipping Scope & Coverage

  • We currently deliver across major pin codes across India
  • We reserve the right to decline delivery to certain pin codes at our sole discretion
  • We cannot deliver to PO Boxes, incomplete addresses, or locations outside mainland India
  • You are responsible for providing an accurate, complete delivery address

8.2 Shipping Costs

  • Free shipping for all orders above INR 3,999
  • Flat fee of INR 200 for orders below INR 3,999 (reflective at checkout)
  • Charges may vary based on the final weight and volume of the package
  • For select pin codes, costs may vary; we will contact you to work out the best option before finalizing your order

8.3 Delivery Timeline

  • Expected lead time: 6–8 business days from order confirmation
  • Saturdays, Sundays, and public holidays are not counted as business days
  • Lead times are estimates and not guarantees; we are not liable for delays beyond our control
  • During peak seasons (festivals, promotional periods), delivery may take 10–12 business days

8.4 Tracking & Visibility

  • You will receive a tracking number via email once your order is dispatched
  • You are responsible for monitoring delivery and ensuring someone is available to receive the package
  • Tracking information is provided by our shipping partner and may not always be real-time

8.5 Delivery Failure & Re-delivery

  • If delivery fails due to an incorrect or incomplete address, you are responsible for providing a corrected address and any additional re-delivery costs
  • We are not liable for delays or failures resulting from incorrect address information provided by you
  • If our shipping partner makes more than 2 failed delivery attempts, we reserve the right to cancel the order and process a refund

8.6 Refused & Tampered Packages

  • If you refuse a delivery without valid cause, we reserve the right to cancel your order and process a refund as a store credit (if applicable under your order terms)
  • If you find that the package has been tampered with or damaged in transit, do not accept the item. Hand over the package to the delivery person before signing the Proof of Delivery (POD)
  • We will investigate tampered packages and may offer a replacement or refund at our discretion

8.7 Risk of Loss

Risk of loss and title for all products pass to you upon delivery to the address provided, or upon your refusal to accept delivery, whichever occurs first.

9. RETURNS & REFUNDS

9.1 Return Eligibility

Your purchase is eligible for return or replacement only if it meets the following conditions:

Eligible for Return:

  • An incorrect product was delivered (product does not match the item description on the website, or a wrong product was delivered)
  • The product has a genuine quality or manufacturing defect or damage

Not Eligible for Return:

  • Variations in colour tone, shape, or size due to the handmade nature of the product (unless the variation is extreme and unreasonable)
  • Change of mind, preference, or fit (artisanal fragrances are final sale unless defective)
  • Damage caused by improper storage, use, or handling by the customer

9.2 Return Process & Timeline

If your purchase meets our return criteria:

  1. Email us within 24 hours of delivery at gavinvaz44@gmail.com with:

    • Order number
    • Delivery address
    • Reason for return
    • For defective or incorrect products, include a clear image of the item

  2. Emails received after 24 hours of delivery will not be considered

  3. We will assess your return request and respond within 2–3 business days

9.3 Resolution & Discretion

  • We reserve the sole discretion to provide resolution as we deem fit
  • Every return or exchange request is treated as an individual case
  • For genuine defects, we will offer either:
    • Exchange for a replacement product, OR
    • Exchange for a different product of the same value, OR
    • Refund of the order amount

9.4 Refund Processing

  • If we approve a return and offer a replacement, we will arrange pickup from your address at no additional cost
  • Refunds will be processed within 7–10 working days after the product is picked up
  • If a replacement is unavailable, we will notify you and process a refund
  • Refunds will be credited to the original payment method

9.5 Special Cases - No Refunds

We are unable to offer refunds in the following circumstances:

  • You provided an incorrect or incomplete shipping address
  • There were more than 2 failed delivery attempts by our shipping agency
  • You refused the package without valid cause
  • For Cash on Delivery (COD) orders, refunds will be issued as store credit coupons only, not as cash

9.6 Non-Refundable Items

The following are non-refundable:

  • Used or opened products (unless defective)
  • Products damaged due to improper storage or customer misuse
  • Seasonal or promotional items marked as final sale

10. LIABILITY & DISCLAIMERS

10.1 "AS IS" Disclaimer

The Services and all products are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Services or products, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee of Results

We do not guarantee:

  • That the Services will be uninterrupted, error-free, or secure
  • That defects will be corrected
  • That the Services or products will meet your expectations
  • Any specific results from the use of our products

10.3 Limitation of Liability

To the fullest extent permitted by law, Maré shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damage to property or personal injury
  • Any damages arising from your use or inability to use the Services or products
  • Even if we have been advised of the possibility of such damages

10.4 Liability Cap

Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid for the product in question.

10.5 Product Use & Safety

  • You use our products entirely at your own risk
  • We are not liable for allergic reactions, skin sensitivities, or adverse effects from product use
  • Always perform a patch test before full application
  • Keep all products out of reach of children
  • Do not ingest fragrances or apply to damaged skin
  • For fragrance-related concerns, consult a dermatologist

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Maré, its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use or misuse of the Services
  • Your infringement of any third-party rights
  • Any content you submit or post
  • Your violation of applicable laws or regulations

12. PRIVACY & DATA PROTECTION

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to our privacy practices as outlined in the Privacy Policy.

13. THIRD-PARTY LINKS & CONTENT

The Services may contain links to third-party websites or platforms operated by other companies. We are not responsible for:

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

14.2 Jurisdiction

You agree that any legal proceedings arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Goa, India.

14.3 Informal Resolution

14.4 Limitation on Legal Action

You agree that any legal action or proceeding arising from these Terms or your use of the Services must be brought within one (1) year from the date the cause of action arises. After one year, the claim is barred.

15. TERMINATION

15.1 Termination by You

You may stop using the Services at any time. However, any orders placed are final and cannot be cancelled unless we agree in writing.

15.2 Termination by Us

We may terminate or suspend your account and access to the Services at any time, without notice, if we determine that:

  • You have violated these Terms
  • You have engaged in prohibited conduct
  • Continued provision of the Services would be illegal or harmful
  • For any other reason at our sole discretion

16. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies we reference, constitute the entire agreement between you and Maré regarding the Services and supersede all prior understandings and agreements, whether written or oral.
